Promotion of Access to Information Act
The Minister has extended the PAIA manual exemption for certain companies
The Minister of Justice and Constitutional Development has very belatedly (signed 30th December 2011 and published 4th January 2012) published a further extension to the publication of the Promotion of Access to Information Act manual for certain companies. The new deadline is the 31st December 2015.

The Minister has published, under section 51(4) of the Promotion of Access to Information Act, an exemption for any private body, except any company which - (a) is not a private company as defined in section 1 of the Companies Act 2008 (Act No 71 of 2008) and (b) is a private company as defined in section 1 of the Companies Act 2008 (Act No 71 of 2008) which -
(i) operates within any of the sectors mentioned in Column One of the schedule to this notice and has more than 50 or more employees in their employment; or
(ii) has a total annual turnover that is equal to or more than the applicable amount mentioned in Column Two of the schedule to this notice. (For the Catering, Accommodation and other Trade the annual turnover threshold is R5 million)
from compiling the manual contemplated in section 51(1) of the first mentioned Act for a period of 36 months from 1 January 2012 to 31 December 2015.
For those FEDHASA members (to which this notice applies) who have, as a result of the original deadline being the 31st December 2011, published their manuals as required, I would suggest that you retain the status quo and only look to updating the manual a month of two prior to the 31st December 2015.
